Terms of Service (Terms and Conditions)

These General Terms and Conditions of Sale exclusively govern the contractual relationship between the company LOCAKOU (hereinafter "the Seller") and any person making a purchase on the website www.kabynbag.com (hereinafter "the Customer").

ARTICLE 1 - WEBSITE PUBLISHER

The website www.kabynbag.com is operated by the company LOCAKOU, a simplified joint-stock company (SAS) with a share capital of €10,000, registered with the Registry of Commerce and Companies (RCS) of BORDEAUX under the registration number (SIRET) 989 665 690 00024.

ARTICLE 2 - PRODUCTS AND ORDERS

The products offered for sale are the travel backpacks and accessories presented on the website. The Customer selects the products, adds them to their cart, and validates their order by proceeding to payment. The sale is final once the Seller confirms the order by email. Products are sold subject to availability.

ARTICLE 3 - PRICE AND PAYMENT

The prices of our products are indicated in Euros (€) including all taxes (TTC), excluding any specific import customs duties which remain the responsibility of the Customer. The Seller reserves the right to modify its prices at any time. Payment is due immediately at the time of the order and is carried out securely by credit/debit card (via Stripe) or any other secure payment method offered on the website.

ARTICLE 4 - SHIPPING AND DELIVERY

Products are shipped via our international logistics center to the delivery address indicated by the Customer during the order process. The applicable delivery times are stated in our Shipping Policy. The Seller shall not be held liable for delivery delays due to the carrier or customs formalities.

ARTICLE 5 - RIGHT OF WITHDRAWAL (RETURNS)

In accordance with Article L221-18 of the French Consumer Code, the Customer has a legal right of withdrawal of 14 days (extended to 30 days under KABYN's commercial policy) from the receipt of their product to change their mind, without having to justify reasons.

The product must be returned new, unused, with its tags, and in its original packaging. Return shipping costs are exclusively the responsibility of the Customer. To initiate a return, the Customer must contact customer service at contact@kabynbag.com.

ARTICLE 6 - WARRANTIES

All our products benefit from the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), allowing the Customer to return delivered products that are defective or non-compliant. In the event of a proven conformity defect within 2 years following delivery, the Customer can obtain the repair or replacement of the product, or failing that, a refund.

Commercial Lifetime Warranty: The Seller offers a commercial lifetime warranty applicable exclusively to manufacturing defects. This warranty is limited to replacing the defective product with a new or equivalent one, free of charge. Excluded from this warranty: cosmetic wear and tear, accidental damage, and deterioration due to inappropriate use or overloading.

ARTICLE 7 - LIABILITY

The Seller shall not be held liable for any inconvenience or damage inherent in the use of the Internet network (service disruption, external intrusion, computer viruses) or in the event of misuse of the product by the Customer.

ARTICLE 8 - PERSONAL DATA

Personal information collected from the Customer is necessary for processing the order and issuing invoices. It is treated confidentially in accordance with our Privacy Policy and the GDPR.

ARTICLE 9 - DISPUTES AND APPLICABLE LAW

These Terms and Conditions are subject to French law. In the event of a dispute or claim, the Customer shall first contact the Seller to obtain an amicable solution (via contact@kabynbag.com). Failing an amicable agreement, the consumer Customer is informed of the possibility of resorting to a consumer mediator. Any remaining dispute shall be submitted to the competent French courts.
